Pacific Web Host's Acceptable Use Policy ("AUP") is provided to give our customers and users a clear understanding of what Pacific Web Host expects of them while using the service. All users of Pacific Web Host Internet services: those who access some of our Services but do not have accounts, as well as those who pay a service fee to subscribe to the Services, must comply with this AUP and our TOS (Terms of Service).

Use of Pacific Web Host Service constitutes acceptance and agreement to Pacific Web Host AUP as well as Pacific Web Host TOS (Terms of Service)

This Acceptable Use Policy applies to all persons and entities (collectively, "customers") using the products and services of Pacific Web Host including Internet service. The policy is designed to protect the security, integrity, reliability, and privacy of both the Pacific Web Host network and the products and services Pacific Web Host offers to its customers. Pacific Web Host reserves the right to modify this policy at any time, effective immediately upon posting of the modification. Your use of Pacific Web Host products and services constitutes your acceptance of the Acceptable Use Policy in effect at the time of your use. You are solely responsible for any and all acts and omissions that occur during or relating to your use of the service, and you agree not to engage in any unacceptable use of the service.

Unacceptable use includes, but is not limited to, any of the following:

Content

Sites that promote any illegal activity or present content that may be damaging our servers or any other server on the internet are prohibited. Links to such materials are also prohibited.

Examples of unacceptable content or links: Pirated software hacker programs or archives, warez sites.

If at any time your site consumes 20% or more of our systems resources you will be contacted to resolve the problem

Illegal Use

Pacific Web Host servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation, or that may directly facilitate the violation of any particular law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of unacceptable content or links include: pirated software, hacker programs or archives, Warez sites, MP3, and IRC bots.

Traffic Usage

Spamming, or the sending of unsolicited email, from an our servers or using an email address or domain that is maintained on our servers machine as reference is STRICTLY prohibited. Pacific Web Host will be the sole arbiter as to what constitutes a violation of this provision.

Spamming (Unsolicited Email)

Spamming, the sending of unsolicited mass email from or through a Pacific Web Host server or using an email address that is maintained on a Pacific Web Host machine is STRICTLY prohibited, and will not be tolerated. Pacific Web Host will be the sole arbiter as to what constitutes a violation of this provision. Customers are also in violation of this provision if they engage in spamming using the service of another ISP or IPP, but reference in the spam a web site hosted on a Pacific Web Host server, or if they sell or distribute software on their web site that facilitates spamming. Violators will be assessed a minimum fine of $400 and will face immediate suspension.

Tortious Conduct

No one shall post unlawful or defamatory information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.

Background Running Programs

We may allow programs to run continually in the background such as cron jobs. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed. You will be notified before charges are incurred

IRC

Sorry, but we currently do not allow IRC or IRC bots to be operated on our servers.

Server Abuse

Any attempt to undermine or cause harm to a server, or customer, of Pacific Web Host is strictly prohibited.

Even attempting to view any system files or to alter material that is not owned by your username, will result in immediate removal of your account. Mere possession of any scripts related to hacking, sniffing, or smurfing will lead to an effort on our part to track your destination and prosecute to the full extent of the law.

Refusal of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Consequences of Violation

When Pacific Web Host becomes aware of an alleged violation of its Acceptable Use Policy, Pacific Web Host will initiate an investigation. During the investigation Pacific Web Host may restrict customer 's access in order to prevent further possible unauthorized activity. Depending on the severity of the violation, Pacific Web Host may, at its sole discretion, restrict, suspend, or terminate customer's account and/or pursue other civil remedies. If such violation is a criminal offense, Pacific Web Host will notify the appropriate law enforcement department of such violation.

Pacific Web Host does not issue service credits for any outages incurred through service disablement resulting from Policy violations.
